Terms of Service

1. The FaxyFox Service

FaxyFox provides online tools that allow users to send and receive fax transmissions without a traditional fax machine.

We may use third-party telecommunications, hosting, payment, authentication, storage, email, and infrastructure providers to operate the service.

Fax transmission relies on telephone networks and third-party systems outside of our direct control. We therefore cannot guarantee that every fax will be successfully transmitted or received.

2. Accounts

Certain FaxyFox features require an account and a verified email address.

You are responsible for maintaining control of your account and for activity performed through it. You agree to provide accurate information and to notify us if you believe your account has been accessed without authorization.

You may not create multiple accounts for the purpose of repeatedly obtaining promotional or free-use allowances.

3. FaxyFox Credits

FaxyFox uses credits for certain faxing activity.

Unless otherwise stated at the time of purchase, one FaxyFox credit represents one fax page.

Purchased credits may be used for eligible sending and receiving activity.

Purchased credits are not consumed for activity covered by an active FaxyFox Unlimited subscription. They remain on your account and are available again if the subscription ends.

Purchased credits do not expire unless otherwise clearly disclosed before purchase.

Promotional, complimentary, or included page allowances may be subject to different rules and may expire or reset as described when provided.

Credits have no cash value, cannot be redeemed for cash, and cannot be transferred between accounts unless FaxyFox expressly permits it.

4. Free Credits and Promotional Allowances

FaxyFox may provide free or promotional credits to eligible users.

For example, FaxyFox may provide an initial free faxing allowance to a newly verified account.

Promotional allowances are generally limited to one per customer and may not be repeatedly obtained by creating additional accounts.

We may modify or discontinue promotional offers at any time. Doing so will not remove purchased credits already validly added to an account.

5. Sending Faxes

You are responsible for ensuring that the fax number you enter is correct and that you are legally permitted to transmit the material you send.

A transmission status indicating that a fax was successfully sent means that our system or telecommunications provider reported successful transmission. It does not necessarily establish that a particular person viewed, read, or acted upon the fax.

Transmission times vary based on the number of pages, telephone-network conditions, the receiving equipment, and other factors.

If a fax fails under circumstances covered by our credit-refund rules, credits reserved or charged for that transmission may be restored to your account.

6. Unlimited Sending Subscriptions

FaxyFox offers an optional monthly subscription, FaxyFox Unlimited. A subscription is never required to use FaxyFox; credits remain available to anyone who prefers to pay as they go.

While a subscription is active, eligible outgoing faxes to supported telephone numbers in the United States and Canada are not charged per page and are not subject to a fixed monthly page allowance. Sending to destinations outside the United States and Canada is not included.

Purchased credits are not consumed for eligible outgoing faxes while a subscription is active, and are not forfeited. Your credit balance remains available to you and may be used again if your subscription ends.

A subscription includes unlimited incoming pages on a fax number held on the same account. The included-page allowances and overage rules described elsewhere in these Terms apply to numbers held without an active subscription.

A subscription entitles you to one fax number free of charge for the duration of the subscription. A number is not assigned automatically; you must select one through your account. A number obtained under a subscription ends when the subscription ends and does not continue as a separately purchased number.

Subscriptions renew automatically each month until cancelled. You may cancel at any time through your account at no cost. Cancellation stops future renewal charges and does not end a monthly term that has already been paid for; access continues until the end of that term.

Unlimited sending is subject to reasonable fair use, as described in our Fair Use Policy at faxyfox.com/fair-use, which forms part of these Terms for subscribers. That policy does not impose an undisclosed numerical sending limit. It permits us to review, and where necessary restrict, usage that constitutes mass distribution, automated broadcasting, resale, circumvention, or other abuse.

We will not apply retroactive per-page charges for sending that was covered by an active subscription at the time it occurred.

7. Receiving Fax Numbers

FaxyFox may allow you to obtain a dedicated local or toll-free fax number for a specified service period.

Unless otherwise stated during purchase, a receiving-number purchase provides access to the assigned number for 30 days.

Your fax number remains assigned to your account only while the applicable receiving service remains active.

When service expires or is terminated, the number may eventually be released and reassigned.

You should not continue distributing or using a fax number after your right to use that number has expired.

FaxyFox may use a holding or quarantine period before an expired number is released or reassigned, but we cannot guarantee that an expired telephone number will remain unavailable indefinitely.

8. Included Receiving Pages

A receiving-number term may include a specified number of incoming fax pages.

This section applies to numbers held without an active FaxyFox Unlimited subscription. While a subscription is active, incoming pages are unlimited and no allowance applies.

Currently, eligible 30-day receiving-number purchases may include 100 incoming pages per term.

Included incoming pages apply only to receiving activity and are separate from purchased FaxyFox credits.

Unused included receiving pages do not roll over to a later receiving-number term unless expressly stated otherwise.

When a new eligible 30-day term begins, the included receiving-page allowance resets to the amount associated with that term.

9. Receiving Overages and Paused Receiving

This section applies to numbers held without an active FaxyFox Unlimited subscription. While a subscription is active, incoming pages are not charged, do not draw on credits, and receiving is not paused for want of an allowance.

After your included receiving-page allowance has been exhausted, additional incoming pages may use available FaxyFox credits.

If an incoming fax begins while you have available receiving pages or credits but the fax requires more pages than remain available, FaxyFox may allow that fax to finish so the document is not interrupted midway.

FaxyFox does not create a negative credit balance for these additional grace pages.

Grace pages do not create a debt and are not deducted from a later credit purchase or receiving-number renewal.

After the fax completes, receiving may be paused if you have no included receiving pages and no available credits.

While receiving is paused, previously received documents remain available subject to our document-retention practices, but additional incoming faxes may not be accepted.

Receiving may resume when you purchase eligible credits or when a new receiving-number term begins with a new included-page allowance.

FaxyFox may impose reasonable limits on grace usage to protect against unusually large transmissions, fraud, abuse, or excessive telecommunications costs.

10. Renewals and Automatic Renewal

Receiving-number service may be offered as a one-time 30-day purchase or with optional automatic renewal.

Automatic renewal occurs only if you expressly select or authorize a recurring billing option.

If automatic renewal is enabled, the applicable charge may be processed at the beginning of each renewal term unless you cancel before the renewal is processed.

You may disable future automatic renewal through available account controls or by contacting us at hello@faxyfox.com.

Canceling automatic renewal prevents future renewal charges but does not ordinarily terminate a receiving-number period that has already been purchased.

This section concerns receiving numbers. Renewal and cancellation of a FaxyFox Unlimited subscription are described under Unlimited Sending Subscriptions.

11. Payments

Payments may be processed using Shopify, Shop Pay, and other supported payment methods.

FaxyFox does not directly store complete payment-card details when those details are handled by our payment or commerce providers.

Prices are displayed before purchase. Applicable taxes or other required charges may be added where required by law.

12. Refunds

Because credits and telecommunications services can be consumed immediately, purchases are generally non-refundable once the purchased service or credits have been used, except where required by law.

If you believe you were charged incorrectly or a technical problem prevented you from receiving a service you purchased, contact us at hello@faxyfox.com.

Nothing in this section limits any refund or consumer rights required by applicable law.

13. Acceptable Use

You may use FaxyFox only for lawful purposes.

You may not use FaxyFox to send unlawful, fraudulent, deceptive, threatening, harassing, abusive, defamatory, or unsolicited bulk communications; impersonate another person or organization; distribute malware or harmful material; interfere with the operation of the service; evade usage limits or account restrictions; or violate applicable telecommunications, privacy, advertising, consumer-protection, or other laws.

You are responsible for obtaining any consent legally required before sending a fax.

FaxyFox may suspend or terminate accounts, block destinations, restrict receiving numbers, or refuse transmissions when reasonably necessary to prevent fraud, abuse, legal violations, security problems, or harm to the service or other people.

14. Sensitive Information

Fax transmissions may contain medical, financial, legal, tax, identification, or other sensitive information.

You are responsible for determining whether FaxyFox is appropriate for the information you intend to transmit and whether your use complies with laws or contractual obligations applicable to you.

Unless FaxyFox expressly enters into an appropriate agreement with you stating otherwise, you should not assume that use of FaxyFox makes you compliant with HIPAA or another industry-specific regulatory framework.

15. Document Storage and Deletion

FaxyFox may temporarily store documents as necessary to prepare, transmit, receive, display, troubleshoot, and maintain fax functionality.

FaxyFox is not intended to serve as permanent document storage.

Fax files may be automatically deleted after a limited retention period. You are responsible for downloading and retaining copies of documents that you are required or wish to preserve.

Certain fax metadata, transaction records, and account information may be retained longer for accounting, fraud prevention, security, customer support, dispute resolution, and legal compliance.

16. Service Availability

We work to keep FaxyFox available and reliable, but faxing depends on telecommunications carriers, telephone networks, internet providers, cloud infrastructure, recipient equipment, and other systems outside our control.

The service is provided without a guarantee of uninterrupted or error-free operation.

We may perform maintenance, modify features, impose reasonable usage or security limits, or temporarily suspend functionality when necessary.

17. No Guarantee of Delivery

FaxyFox does not guarantee that a fax will be received by the intended person, routed internally by the recipient, read, reviewed, or acted upon.

You are responsible for independently confirming receipt when delivery is legally, financially, medically, or otherwise important.

18. Third-Party Services

FaxyFox relies on third-party service providers, including telecommunications carriers, cloud-hosting providers, payment and commerce providers, authentication services, and email providers.

Their services may be subject to their own terms, policies, and availability.

19. Intellectual Property

The FaxyFox website, branding, software, graphics, interfaces, and other FaxyFox-created materials are owned by or licensed to FaxyFox and may not be copied or commercially exploited without permission.

You retain ownership of documents and other content you submit.

You grant FaxyFox the limited rights necessary to process, store, convert, transmit, and deliver that content solely for purposes of operating and supporting the service.

20. Termination

You may stop using FaxyFox at any time.

We may restrict, suspend, or terminate access when we reasonably believe an account is being used unlawfully, fraudulently, abusively, in violation of these Terms, or in a manner that threatens the service or other users.

Where reasonably possible, we will attempt to provide notice before terminating paid services, except where immediate action is necessary for fraud prevention, abuse prevention, security, legal compliance, or network protection.

21. Disclaimer of Warranties

To the maximum extent permitted by law, FaxyFox is provided on an “as is” and “as available” basis.

We disclaim warranties not expressly stated in these Terms, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

22. Limitation of Liability

To the maximum extent permitted by applicable law, FaxyFox and its owners, employees, contractors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from use of the service, including lost profits, lost data, missed communications, or failure of a fax to reach its intended recipient.

To the extent liability cannot lawfully be excluded, our aggregate liability arising from the service will not exceed the amount you paid to FaxyFox during the twelve months preceding the event giving rise to the claim.

Some jurisdictions do not permit certain limitations, so portions of this section may not apply to you.

23. Changes to These Terms

We may update these Terms as FaxyFox changes.

When material changes are made, we will update the effective date and provide additional notice when legally required.

Your continued use of FaxyFox after revised Terms become effective constitutes acceptance of the revised Terms to the extent permitted by law.

24. Governing Law

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles, except where applicable law requires otherwise.
